In the course of its enforcement and administration of the Building Code Act, 1992 (the "BCA"), Toronto Building (TB) encounters situations where it urgently requires the services of qualified professional engineers, including engineers with structural engineering experience related to the evaluation and assessment of buildings that are in a compromised or unsafe state. For instance, TB responds to and investigates reports of buildings that may be unsafe. An unsafe building is defined in the BCA as a building:

(a) which is structurally inadequate or faulty for the purpose for which it used; or
(b) in a condition that could be hazardous to the health and safety of persons in the normal use of the building, persons outside the building or persons whose access to the building has not been reasonably prevented.

The reports that TB receives about potentially unsafe buildings arise in a variety of scenarios, including where there has been an accident (ie. vehicle colliding with a building), a lack of maintenance over a prolonged period of time, or where there has been a fire. TB investigates such situations and inspects the building to determine how best to enforce and administer the BCA. In the majority of cases, a review by a professional engineer with structural engineering experience is required.

The urgency of a given situation depends on the particular facts but there is a general need for TB to be in a position to act swiftly, including the deployment of an engineer to assess an unsafe building or emergency situation. Building owners will often be in a position to deliver their own engineering assessment and offer proposed remedial steps to remove unsafe conditions. It is in cases where TB determines that it must have its own engineering assessment that it may use the vendors selected through this RFSQ.

In addition, TB also deals with court orders where unauthorized construction has been ordered to be removed. TB may also use the vendors selected through this RFSQ to provide engineering services to oversee the demolition to ensure that it is carried out in an appropriate manner (ie. Such that it will not adversely affect adjacent properties or permitted construction).
