Response of Toronto EMS to Local 416 regarding immunization against influenza

Response of Toronto EMS to the constitutional challenge initiated by Toronto
Civic Employees Union, Local 416 regarding the mandatory requirement for
paramedics to be immunized against influenza.

On January 25th, 2001 Toronto EMS was notified that Toronto Civic Employees
Union, Local 416 will make application to the Ontario Superior Court of Justice
to have the provisions of the Ambulance Act pertaining to the mandatory
requirement for paramedics to be immunized against influenza be declared
contrary to the Canadian Charter of Rights and Freedoms.

In view of the action taken by Local 416, Toronto EMS is prepared to defer any
action against paramedics who have not received the vaccination until a
judicial ruling has been made.

Toronto EMS continues to support initiatives to protect both the public and
healthcare professionals against influenza and will continue to encourage its
staff to be immunized.

Since this matter is now before the courts Toronto EMS will be unable to
provide further information or answer additional questions at this time.
